General Terms and Conditions of Sale

Reference version: Italian. In case of discrepancy the Italian version prevails.

1. Scope of Application

These General Terms and Conditions govern the purchase of tickets and any related services through the website operated by MK Company Sagl.

By placing an order, the customer declares to have had the opportunity to read and accept these Terms and Conditions before purchase.

2. Offer and Purchase of Tickets

The website indicates the essential characteristics of the event or service that can be purchased, such as, as applicable, the event, date, venue, ticket type, price, any included services and any specific access conditions.

Ticket availability is limited to the quantities available. Placing a ticket in the cart does not constitute a definitive reservation.

3. Order Procedure and Conclusion of the Contract

Before submitting the order, the customer has the opportunity to review the selected products or services, the quantities, the total price and the information entered and, where technically possible, to correct any errors.

By submitting the order via the relevant purchase button, the customer places a binding order. The contract is deemed concluded upon the order confirmation sent electronically to the email address provided by the customer, subject to any obvious system errors or unavailability communicated promptly.

The customer is responsible for the accuracy of the email address and other information provided during the purchase.

4. Prices

The prices applicable are those displayed on the website at the time of purchase. Before confirming the order, the customer is shown the total price to be paid, including any applicable mandatory surcharges. Any optional services are indicated separately and are charged only if selected by the customer.

5. Payments

The available payment methods are displayed during checkout. Depending on the methods active on the website, payment may be processed through external providers specialised in payment services, including WooPayments and TWINT.

MK Company Sagl does not directly collect or store complete payment card data when such information is entered directly into the systems of the respective payment provider.

The order may be considered valid only after the payment has been correctly authorised or registered, unless a payment method expressly provides for different conditions. In the event of a declined, cancelled or incomplete payment, MK Company Sagl may not issue the relevant ticket.

6. Issuance and Delivery of the Ticket

After the order has been correctly completed, the ticket is normally provided in electronic format to the email address given by the customer or made available through the means indicated during purchase.

The customer is required to check receipt of the ticket and the accuracy of the information shown on it. Any issues must be reported promptly to MK Company Sagl.

7. QR Code, Barcode and Ticket Validity

When the ticket contains a QR code, barcode or other unique identifier, such code normally allows only a single admission to the event, unless otherwise indicated.

The customer is responsible for safeguarding their own ticket. The public disclosure, duplication or unauthorised sharing of the QR code may allow third parties to use the ticket. In the event of multiple copies of the same ticket, the first code correctly verified at the entrance will be considered valid.

8. Admission to the Event

Admission is subject to presentation of a valid ticket and compliance with any access conditions communicated by the organiser.

The organiser may refuse admission to, or remove from the event, persons who pose a danger to themselves or others, seriously disturb the running of the event, or fail to comply with safety rules and the rules of the host venue. Any age requirements or other specific restrictions are indicated on the event page or in the related communications.

9. VIP Tickets and Additional Services

The services included in VIP tickets, packages or special categories are exclusively those indicated in the description of the offer at the time of purchase. Services or benefits not expressly indicated cannot be considered included.

10. Customer Withdrawal and Non-Attendance

Unless otherwise expressly indicated in relation to a specific event and without prejudice to any mandatory rights provided for by law, tickets purchased are non-refundable in the event of withdrawal, personal inability to attend, or the customer's failure to attend.

The customer's personal decision not to attend the event, including for reasons related to weather conditions, does not give rise to a right to a refund.

11. Changes to the Programme

For musical, cultural or entertainment events, programmes, schedules, artists, DJs, performers, areas or services may be subject to changes for artistic, technical, organisational, safety reasons or reasons beyond the organiser's control.

A change to the lineup or schedule that does not result in the cancellation of the entire event does not automatically give rise to a right to a refund, subject to what is provided by law or expressly communicated by MK Company Sagl.

12. Running of the Event in the Event of Bad Weather

The event takes place even in the event of rain or adverse weather conditions.

The organiser provides covered areas and adopts the measures necessary to ensure, as far as reasonably possible, that the event takes place safely.

Rain, moderate wind, temperature variations or other normal bad weather conditions do not constitute grounds for cancellation of the event and do not give rise to a right to a ticket refund.

13. Severe Weather Conditions

The event may be suspended, interrupted or cancelled if severe or exceptional weather conditions occur such that the event cannot be held safely, or if suspension or cancellation is ordered by the competent authorities.

The decision will be made by the organiser taking into account the safety of the public, artists, staff and all persons present.

14. Cancellation Due to Severe Weather Conditions

In the event of the definitive cancellation of the entire event before it takes place due to severe weather conditions, tickets purchased will be refunded.

MK Company Sagl will inform customers of the refund procedures and timing through its official channels and/or the email address used for the purchase.

The refund covers the price of the ticket purchased, subject to any different provisions under the law or the conditions applicable to any additional third-party services.

15. Interruption of the Event After It Has Started

If the event has already begun and must subsequently be suspended or interrupted due to severe weather conditions or safety reasons, any right to a refund and the corresponding amount will be assessed based on the time of the interruption and the portion of the event already duly held, in compliance with applicable legislation.

16. Postponement of the Event

In the event of postponement of the event, MK Company Sagl will communicate, as far as possible, the new applicable conditions and the validity of tickets already purchased. Any refund arrangements will be communicated based on the specific circumstances and applicable legal obligations.

17. Cancellation of the Event for Other Reasons

In the event of the definitive cancellation of the event for reasons other than weather, MK Company Sagl will inform ticket holders of the applicable refund procedures.

The refund may be made, where technically possible, using the same payment method used for the purchase. Any costs or third-party services already actually used will be handled according to the conditions communicated for the specific purchase and in compliance with applicable legal provisions.

18. Force Majeure and Safety

MK Company Sagl cannot be held liable for changes, suspensions or the impossibility of performing all or part of the event resulting from extraordinary circumstances beyond its reasonable control, such as measures ordered by the authorities, emergencies, serious safety issues, natural disasters, significant disruptions to essential services or other similar events.

Ordinary bad weather, including rain, does not in itself result in the cancellation of the event. With regard to weather conditions, the provisions set out in the sections on the running of the event in the event of bad weather and on severe weather conditions specifically apply.

19. Liability

MK Company Sagl is liable in accordance with the mandatory provisions of Swiss law. To the extent permitted by law, MK Company Sagl is not liable for damages arising from conduct attributable to the customer, improper use of tickets, or events beyond its sphere of control.

20. Data Protection

Personal data collected in connection with the purchase and management of tickets is processed in accordance with the Privacy & Cookie Policy published on the website.

21. Changes to the Terms

MK Company Sagl may update these Terms and Conditions. The version made available to the customer at the time the order is concluded applies to each purchase.

22. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Swiss law. Mandatory provisions regarding jurisdiction applicable to contracts concluded with consumers remain unaffected.
